Watson Millican’s technical experts were retained through counsel for a solar farm developer’s dispute with one of their consultants. The consultant had requested a bonus several magnitudes higher than those normal in the industry for such a project.

The Dispute

A solar farm developer had retained the services of a consultant to develop small solar farms in the UK. While commercial terms were discussed, no contract was executed. However, the consultant was paid a retainer and bonuses consistent with the terms discussed. The consultant was later assigned to work on a much larger wind farm development, which was a JV with another developer where the consultant’s responsibilities were very different from those in the smaller solar parks. When the large solar park received it’s planning permission, the developers sold out their share of the project and the consultant requested a significant bonus for the works he had carried out.
